14 - Writ of Mandamus Hearing;
The
court hearing was confusing to say the least. Until the judge’s
order is released, the exact outcome is uncertain. That fact being
taken into account, it seems that Count 1: Mandated members’
inspection of Sec records: brought by Charlene West was approved.
The
rest of the counts were ignored by Judge Reynolds with no ruling
at all. There was some mention of the Counter Suit/Class Action,
brought in answer to the Board of Trustee suit against all SEC
members, that is presently in court under Judge Mitchell and the
overlap in the Mandamus Counts with that suit. Not to be impolitic
but it seems to be a judicial game of “Kick the Can down
the road.”

The
SUPPLEMENTAL PETITION FOR 2ND ALTERNATIVE WRIT OF MANDAMUS (posted
here) will be heard in Judge Matthew Reynolds’ Court on Wednesday,
December 12, 2012 at 10:00 A.M. All of the SEC members interested
in the function and dysfunction of the Socorro Electric Cooperative
should attend.

Many of you are calling or emailing The SEC Reform Group to ask
what to do about the postcard from the SEC. We advise that you
ignore it and save the postage for your Christmas cards. This
postcard has no meaning except as proof that the SEC does not
mind wasting the member’s money. Add up the fee to Survey
and Polling, the printing cost, the mailing cost for something
that is covered by a New Mexico State law and New Mexico Supreme
Court decision and cry shame to the SEC Board of Trustees, management
and their lawyers.
